Terms of Use

These Terms are an agreement between you and 2Workout. Please read them: by creating an account or using the Service you accept them.

1. About these Terms

These Terms of Use (“Terms”) govern your use of the 2Workout mobile apps, website and related services (the “Service”), operated by [Legal entity name], [Registered address] (“2Workout”, “we”, “us”). Our Privacy Policy, Cookie Policy and Health Disclaimer are part of these Terms.

2. Who can use 2Workout

  • You must be at least 16 years old, and the age of majority in your country to buy a subscription.
  • Trainers must be at least 18 and legally able to offer personal training services where they work.
  • You must give accurate information and keep your password safe. You are responsible for activity on your account.

3. What 2Workout is, and is not

2Workout is a software tool that lets Trainers and Clients connect, share plans, log sessions and follow progress. We do not provide personal training, medical, nutritional or health services, we do not employ or supervise Trainers and we are not a party to any agreement between a Trainer and a Client (including price, schedule, location or payment for coaching sessions).

4. Trainers

If you use 2Workout as a Trainer, you confirm and agree that:

  • the qualifications, certifications and experience you show are true, and you hold any licence and insurance your work requires;
  • you are solely responsible for the programmes, advice and supervision you give, and for adapting them to each client's health, level and limitations;
  • you will use clients' data only to coach them, keep it confidential and comply with the privacy laws that apply to you;
  • you will review the AI coach's answers with professional judgement before acting on them (section 7).

5. Clients

  • Before starting any programme, check with a doctor that it is safe for you, and tell your Trainer about any injury, condition or medication that matters.
  • Stop exercising and seek help if you feel pain, dizziness, chest pain or shortness of breath.
  • You choose which Trainers you connect with and can end a coaching relationship at any time in the app; you should check a Trainer's credentials yourself.

6. Your content

You keep ownership of everything you add to 2Workout (plans, workouts, videos, notes, measurements and other content). You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and transmit it only as needed to run and improve the Service and to show it to the people you share it with. For public Trainer profiles, this includes showing them publicly. The licence ends when you delete the content or your account, except for copies a Client received from you (for example, a shared plan) and backups kept for a limited time.

You confirm you have the rights to everything you upload, including music in videos and images of other people, and that it does not break the law or anyone's rights.

7. AI coach

The AI coach generates answers automatically from a Trainer's own client data. Answers may be incomplete or wrong, are not medical advice and must not replace professional judgement. You are responsible for how you use them.

8. Acceptable use

You must not:

  • harass, threaten, discriminate against or exploit anyone, or contact users for anything other than coaching;
  • impersonate anyone or misrepresent your qualifications;
  • upload sexual, violent, hateful or illegal content, or promote dangerous practices or banned substances;
  • access other people's data without permission, scrape the Service, or try to break its security;
  • reverse engineer the Service, except where the law allows it;
  • use the Service to send spam or for any unlawful purpose.

We may remove content or suspend accounts that break these rules.

9. Subscriptions, payments and advertising

  • Some features of 2Workout may require a paid subscription. The price, billing period and what it includes are shown in the app before you buy, and may differ for Trainers and Clients.
  • The Service may show advertising. Where a subscription removes advertising or unlocks features, the app says so before you buy.
  • Subscriptions renew automatically at the end of each period at the then-current price until you cancel. You can cancel at any time in your App Store or Google Play subscription settings, at least 24 hours before the renewal date; access continues until the end of the paid period.
  • Purchases through Apple or Google are processed by them under their terms, and refunds follow their policies. Where the law gives you a right of withdrawal, it applies.
  • We will tell you in advance about any price change, and you can cancel before it applies.

10. Third-party content

Some exercise content comes from third parties such as ExerciseDB by AscendAPI and is shown with their attribution. Links to other sites are provided for convenience; we are not responsible for them.

11. Our intellectual property

The Service, its software, design, name and logos belong to 2Workout or its licensors. We give you a personal, revocable, non-transferable licence to use the apps for their intended purpose. Feedback you send us may be used freely to improve the Service.

12. Ending your use

You can stop using 2Workout and delete your account at any time. We may suspend or close an account that breaks these Terms or the law, or puts others at risk, and will tell you why unless the law prevents it. We may change or discontinue features; if we shut the Service down we will give reasonable notice so you can export your data.

13. Disclaimers

Exercise involves risk of injury. To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of AI answers or uninterrupted availability. We do not guarantee any fitness, health or body composition result.

14. Limitation of liability

To the maximum extent permitted by law, 2Workout will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, nor for injuries arising from exercise, nutrition or advice given by Trainers. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or 100 US dollars. Nothing in these Terms limits liability that cannot be limited by law, such as for death or personal injury caused by our negligence, fraud, or your statutory consumer rights.

15. Indemnity

If you are a Trainer, you agree to defend and indemnify 2Workout against claims from your clients or third parties arising from your coaching services, your content or your breach of these Terms, to the extent permitted by law.

16. Changes to these Terms

We may update these Terms. We will post the new version here and, for material changes, notify you in the app or by email at least 15 days in advance. If you keep using the Service after that, the new Terms apply; if you disagree, you can delete your account.

17. Law and disputes

These Terms are governed by the laws of [Country / State], and its courts have jurisdiction, without depriving consumers of the protection of the mandatory laws and courts of the country where they live. Before going to court, write to us and we will try to solve the issue informally.
